Terms of Service

These Terms of Service ("Terms") govern the use of the yapt. platform ("Platform"), operated by New Way Soluções Digitais Ltda. ("New Way", "we", "us"), CNPJ 17.738.064/0001-97.

1. Acceptance

By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. Description of Service

yapt. is an AI-powered conversational platform designed for sales management. It includes a unified inbox, lead qualification, automations, CRM, communication channel integrations, and AI tools.

3. Registration and Account

  • You must provide accurate information and keep it up to date
  • You are responsible for the security of your credentials
  • Each account must correspond to a single company or individual
  • Trial accounts may be terminated after 14 days of inactivity

4. Acceptable Use

You agree to:

  • Use the Platform in compliance with applicable laws
  • Not send spam, illegal, or unsolicited content
  • Not attempt to access other tenants' data
  • Not reverse engineer or decompile the Platform
  • Respect the usage limits of your plan

5. Integrations

The Platform integrates with third-party services (WhatsApp Business API, Meta Ads, Google Ads, among others). Use of these integrations is subject to each provider's terms. We are not responsible for interruptions or changes in third-party services.

6. Artificial Intelligence

  • The Platform's AI assists with lead qualification, response suggestions, and automations
  • AI-generated responses are suggestions and do not replace human judgment
  • You are responsible for reviewing and approving AI actions when necessary
  • We do not guarantee absolute accuracy of AI analyses

7. Intellectual Property

The Platform, including its source code, design, brand, and content, is the property of New Way. You receive a limited, non-exclusive, and revocable license to use the Platform according to your plan. Data you input remains your property.

8. Availability and SLA

  • We strive to maintain the Platform available 99.9% of the time
  • Scheduled maintenance will be communicated 48 hours in advance
  • For Enterprise customers, specific SLAs may be negotiated

9. Limitation of Liability

To the maximum extent permitted by law, New Way shall not be liable for: indirect damages, loss of profits, interruptions caused by third parties, or actions taken based on AI analyses. Our total liability is limited to the amount paid by the customer in the preceding 12 months.

10. Termination

  • You may cancel your account at any time
  • We may suspend or terminate accounts that violate these Terms
  • After cancellation, your data will be retained for 30 days for recovery and then deleted

11. Changes

We may modify these Terms at any time. Significant changes will be communicated 30 days in advance. Continued use of the Platform after changes constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms are governed by Brazilian law. The courts of São Paulo/SP, Brazil, are elected to resolve any disputes.
